Copyright Law

Under the Copyright Act in Australia copyright protection is automatically applied to artistic works as soon as they are created.  The owner of copyright in an artwork has the exclusive right to reproduce, publish and communicate that work to the public.

The images on this website are protected by copyright law and remain the property of the artist. 

The downloading, display, print or reproduction of these images in unaltered form is allowed for personal, non-commercial purposes only.

Please respect these artists copyright ownership and do not, in any form or by any means:

    1. adapt, reproduce, store, distribute, transmit, print, display, perform, publish or create derivative works from any part of this web site; or
    2. commercialise any information, products or services obtained from any part of this web site, without the written permission of Ethel & Co Fine Art or the respective artist.

      Ethel & Co Fine Art works with Viscopy, as well as undertaking independent research, in order to obtain permission to publish images of artworks online. There are a small number of cases in which we have been unable to trace the copyright holders of particular works, despite making every effort to do so. We welcome hearing from anyone with information about artists listed on the Ethel & Co website and will happily update the website to include acknowledgments as required.

      Resale Royalties

      Under the artists' resale royalty scheme, artists receive royalties on certain resales of their work. Copyright Agency has been appointed by the government to collect royalties to pay to the artists. 

      As required under this scheme, Ethel & Co Fine Art is registered with Copyright Agency and reports all commercial resales of $1,000 or more.  Ethel & Co Fine Art, as the seller of the work, is responsible for paying the royalty.

      Display & Moral Rights

      Ethel & Co Fine Art takes its duty of care in relation to these artworks seriously.  The gallery exercises diligence and care when handling, storing and packing artworks.   Works in our care will not be altered or otherwise compromised.

      The gallery undertakes to correctly and clearly attribute artworks to their creators. We make every effort to research artworks and provide reliable information about the work and the artist.

      Re-framing & Conservation

      Ethel & Co Fine Art assesses the condition of artworks purchased on the secondary market and, if necessary, arranges for professional re-framing and/or conservation work to be undertaken.  We always seek out the advice and services of expert conservators and framers.
